Privacy notice - Adult Social Care

Middlesbrough Council provides adult social care, Social Work, and Occupational Therapy assessment, preventative services, and care management services.

What type of personal data do we collect and how do we collect it?

We collect 'personal data' from individuals and from other organisations including names, contact details including address, telephone number, and email address, date of birth, identification data including NHS Patient Number, National Insurance Number, details about family, relatives, and carers, financial details and circumstances, home situation, housing information, information about any care or other support needs, and details about your involvements with any other social care or health professionals.

We collect 'special category data' including racial or ethnic origin, religious or philosophical beliefs, sex life or sexual orientation, and health data. We also collect 'criminal convictions and offences data'.

How the Law allows us to use your personal data

We use personal data where we have a 'legal obligation' or to deliver our 'public tasks'. We use special category data to 'provide health or social care or treatment or the management of health or social care systems and services' or 'for reasons of public interest in the area of public health'. We also use criminal convictions and offences information for 'statutory and government purposes'.

Some of the laws that allow us to use personal data in this way include the Care Act 2014, Health & Social Care Act 2012, Mental Capacity Act 2005, Mental Health Act 1983, Care and Support (Discharge of Hospital Patients) Regulations 2014, Chronically Sick and Disabled Persons Act 1970, Equality Act 2010, and the Health and Safety at Work Act 1974.

We use personal data to provide you with a range of services and support to meet your assessed needs, investigate any problems or complaints you may have, plan and manage our services and to keep track of our spending, check the quality of our services so that we can develop and improvement them.

Will your personal data be shared?

We share your information with other organisations to help us to deliver services to you or where we have a legal obligation to do so. Some of the organisations that we share personal data with include a wide range of health and social care bodies, other local authorities, independent social care providers, independent housing providers, fire brigade, police, courts, probation, voluntary and community sector groups, other council services such as children's services, housing solutions, recovery solutions, neighbourhood safety teams, public health, resident and business support, and UK Government Departments such as the Home Office, Department of Work and Pensions, and the Office of the Public Guardian.

How do we keep your personal data secure?

We use the following measures to ensure that your personal data is secure: data protection and security policies, information security incident reporting, data and device encryption, system and data access controls, user accounts and passwords, physical and environmental security, staff vetting practices, staff training and awareness, data back-ups, ICT network penetration testing, and business continuity and disaster recovery plans.

How long will we keep your personal data?

Is your personal data processed overseas?

We do not send personal data overseas.

Marketing

We will never use your information for direct marketing purposes. However, from time to time we may use your information to send you public service messages about the services you receive from us.

What are your information rights?

Your Information Rights are set out in law and, subject to some exceptions, you have the:

  • Right to rectification - to ask for information to be corrected
  • Right to erasure - to have your personal data deleted
  • Right to object - to how your data is used
  • Right to restriction - to request limits on how your data is used
  • Right to portability - to request that we move your data to another organisation
  • Right of subject access - to request a copy of data the Council holds about you

National Data Opt-Out

Middlesbrough Council complies with the National Data Opt-Out Policy.

This means that you have a choice about whether you want your confidential patient or social care information to be used and provided to other organisations for purposes beyond your individual care. If you are happy with this use of information you do not need to do anything. If you do choose to opt out your confidential patient and social care information will still be used to support your individual care.
